I need help.
« on: November 19, 2011, 05:56:39 PM »
Back in 2007 I paid Diggory Press to publish my novel, Caxton Tempest at the End of the World.
I was attracted to them by their low cost and the fact that they let the author keep copyright.

There has been some changes in the years since, with several authors complaining that Diggory have not paid them any royalties, and taking them to court.

Recently I have decided to republish Tempest, along with another novel, but this time going it alone, or possibly through Lulu. I have tried contacting Diggory to ask for my book to be deleted from their system, but the Diggory website has closed down and my emails are being unanswered.

I would just like to make sure that this previous edition of my book is not going to be bought, when I bring out the new one.

Any sugggestions as to what I can do?

Thanks,
Ken :)

You could try asking some of the other authors who have been dissatisfied with Diggory if they know anything. You could check to see if the novel is still for sale. Did you save a copy of the terms from when you dealt with them? You might want to reread them. You should keep up to date with the court proceedings. Maybe consult with a copyright lawyer if you can afford it. There's probably other stuff you can do but I don't know what.

Hi Ken, I don't know if this will help. These people seem to have bought the name and are stating a few facts, as they know them, about the previous owners. Also on Absolute write writers beware there is about eight pages of negative stuff to trawl though, but more importantly authors who have  authors who have had dealings with them. It may be there you will find an answer.

My own view is having been taken to court or in the process of, I wouldn't think it wise for them to supply any books from disgruntled authors in case of another court procedure.

I'd also google your book to see if it pops up for sale in places it shouldn't.

Personally if I'd bought that name, I would have dumped it pretty darn quick when I found out about the shennanigans. Not sure it would be wise to keep.

This is the most up to date info I found

And this is some of the authors complaints, but there is an email on there you might try for information.

Thanks Thatollie for those suggestions. Most sites the novel isn't listed anymore. It's on Amazon, but only secondhand or through private sellers. I think I will get in touch with some of the other authors.

Thanks Mairi for all your detective work! Are you a PI on the side?  :)
I have been to the Diggory site. I'm not sure it has been taken over by somebody else you know. If you actually sit down and wade through some of the stuff on the site it all starts to take on a defensive tone, which makes me wonder if Rosalind (who I think basically ran Diggory) is trying to defend herself through an assumed id. Hmm...

Thanks for the other sites and PDFs. I think I will contact these guys and see what they have to say.
Basically though, on the copyright page of my novel, it states that I hold the copyright, so I am free to do whatever I want with it. My manuscript is still mine.
I am also sure that I am not owed any money (or if I am, it'll run into pounds at the most.) As I said before, I just want to make sure I am selling the only edition when I republish.

Thanks guys, I appreciate you both taking time to think about my question and reply. I'll update you when I learn anything more.
Cheers,
Ken :)

BTW Thatollie, great word count for Nano!! Well done!
